Hi All
I read a previous post (which I can't find), where there was info about if I build and pay for a house on my inlaws block of land (which they have sighned over to my wife already), that I can go to the lands office and somehow get a lease on the house that stops it from being sold for I think- 30 years.
Is this true and what are the details, thanks in advance.

Lease is for the house, the land, or both?

Or you can get a usafruct,which give you the right to use the land.You can own the house ,but not the land.But if you are going to build on the family land and for some reason you breakup,you won't be able to stay there anyway.There is a 99% chance you would be most unwelcome there unless you were continuing to support the family generously enough to keep you around.

What ever you decide to spend on building,you might as well get used to the idea that it is gone for you unless you stay together and if you put the house in your name only,it might be a bone of contention that could cause you relationship problems.

You might want to considr all this before you make a big cash injection!

Totally agree Stan, except that leasing the land from one's spouse is as good a nuptial agreement as any!!
I bought land here in Nong Sai in my girlfriend's name and then leased from her for 30 years. Her family is from Ubon so there's no problem if we part ..... but there again that will never, never happen as I am a great guy and my g/f is different from all the rest

That's great Hugh,WE are the exceptions

you cannot lease anything from a legal spouse . but as stan rightly says you can get a userfract , which entitles you to use it untill your death . if not legally married you can get a 30 year lease .

Funny, my neighbor is leasing his house from his wife. And she's paid tax on the income as well.

Your best bet is to get the usafruct. We did it ourselves at the land office for less than 100 baht (mostly photocopying fees). But Stan is right - once you two separate (and looking at the statistics, there is a really good chance its going to happen) you are unlikely to be able to remain living on that land, especially if its in or near your wife's village.

Thanks for the info, my situation is I might lose my wife to illness and I will be supporting her parents and have just started building a new house for them on their land replacing their old one, and will build a house for me to live there in 2-3 years, I forsee any problems, but wanted to just cover myself.

Best of luck to you!What ever you are doing ,you understand the possible consequences going in,so sounds like you are doing what you feel is best for your situation!

I knew of a very rich American that lived in his village near Pitsanalouk for 11 years.Build a rec center,soccer pitch w/outfits for the kids and 2 houses for the family and himself.Felt the love and appreciation of the family and the village while he was there!

His wife died of cancer!As soon as the funeral was over,members of the family started taking furnishings and property from his house.When he protested they told him ''You go''!

He didn't feel any financial pain,but was devastated about the abruptness and lack of caring for him!

Imagine what it would have been like if he didn't have ample resources in reserve?

I don't think he ever considered a lease or an usafruct!But it wouldn't have made any difference in his circumstances!

A correction in my post should read "I don't forsee any problems", as without my help they would have nothing, only a house which they had already, I've just renewed it.
So to do this usafruct,
1/ Where do we go in Udon (we are near Englishmans Retreat, I think it's a lands office at the end of that road)
2/ What do we take (the title is already in my wifes name, and I don't have a visa as we only visit 2-3 times a year for 2-3 weeks at a time as we all live in Oz until we decide to move to Udon in about 2 years)

As I recall, we just took the title, wife's ID card, and my passport to the land office and told them what we wanted to do.

We were given all the help we needed, but only after we sat with the "Boss" and listened to him give general advice for about 20 minutes, during which he would pause every now and then and wait for something to happen (use your imagination). Eventually, he gave up and sent us back to the counter and start the process.

There was some photocopying, for which we paid small Baht, and the payment of a small fee, about 50 Baht from memory, and we were out of there in about an hour. Your mileage WILL vary.
