Age of Consent

PostAuthor: ph55059 » July 12, 2008, 2:44 am

Hi All,

I came across this site and thought you might find it of interest:

http://www.avert.org/aofconsent.htm

I found the Legal AoC in parts of Europe and Asia very surprising.

Interesting in the fact that there are many variances between countries and in some cases within countries!Make me wonder what and why the different reasoning?

I you are referring to the differences amongst some Oz states, the explanation is simple (even if not sensible).

As a federation, the responsibility for setting age of consent is in the hands of the individual states/territories. Whilst most states have harmonised (which has not always been the case), a couple of them obviously have different ideas.

Probably a combination of factors including economic expectations (high school vs farmwork), sexual maturity ages (lower near the equator), etc.

Yes - but I believe it is the same in all states/territories ie 18.

Under the Oz constitution, the Commonwealth (Federal) gov't has certain defined powers and responsibilities, with all others going to the states. However the High Court has over a number of years whittled away the powers of the states, and given them to the Feds.

There are also a number of areas eg laws relating to corporations, where all the states have signed their powers over to the Commonwealth.

My understanding is that the Oz system is the opposite of the US, where the states have defined powers, and the Feds get the balance. Can one of our American correspondents please correct me if I am incorrect.
