house ownership

My wifes father lives on a property in non sang , he has two brothers, when his father died he payed his brothers out for theire share of th property,but this was done on scraps of paper, nothing official,My wife is helping to build a house on this land which is half built, I have explained to her that she is ..taking a chance as she or her father dont officialy own the land and that some of her brothers sibblings can come and make claims at some future date,
What can i advise her to do to correct the situation.

Sounds like your wife needs to contact a lawyer. I certainly wouldn't take a chance, like finishing any more building, until I got this straightened out... LEGALLY. :shock:

Get a lawyer to check with the land office to see who the land belongs to.
A scrap of paper don't sound like a chanote to me.
Don't get involved and lose your shirt, at a later date.
Just take care of you and your wife.

The best way around the problem is to rent somewhere to live rather than jump into it head first spend a min on her stand back and observe her like a rat in a lab and observe the test of time. If the subject becomes demanding and yee can smell ball crap she is a bad one put her in the bin and move on to the next subject and start the process again till the good one passes the test of time .


Symptoms of a bad egg include

1. The subject becomes comes up with story of sick farm animals and illness in the family

2. Card schools related to (missing objects in the house)

3. Lack of intrest when you tell the subject have to eat on the noddle stall cause funds are tight

5. The subject grills you with questions about you personal finances in the first 3 months

6. Money walking out of your wallet

All im saying is jai yen yen there are good ones out there but you can't hurry love ...you just have to wait ...it IS a game of give and take

stop building immediately and write it off as a loss. unless all are ready to sign immediately the land over to her. anything else is wasted time and money. since you are in the picture, just guessing (ASSuming), but you can buy land for what they would want for signing off. and if this is to be for you and your wife, do you really want to live with her family, not near, WITH.

I concur with LA!!!You have no complaints if you don't take action now!
There is no value to them if the house is not completed If they don't sign off you should not waste another baht on the house or the family! ](*,)

It sounds like you have the basic situation figured out.

You can use an attorney if you want, but your wife and you can just go to the land office by yourselves and ask who owns the land. You can even ask the people at the land office for advice as to what your wife would have to do in order to get the land in her name. And that would be a pretty good way to start sorting things out.

Hi again, The land is still in her grandfathers name, he has three sons,her father has an ageement that the ownership will pass to him, I am going to sugest that ownership will pass to my wife ,as it has not been transfered, Guys I am lucky My wife works and only askes that i send her ernings to the family
as the cash builds up but i must admit i do add to it, the family is poor but hard working and undemanding,I will not live in the area near the family ,I have learnt from other guys what that cost
I dont intend to go back to uni at my time in life .Hope to meet up with some of you in dec/jan i hear the 3 jan is the get together. will be there if the irish clock answers my e mail regarding accomidation

I have a similar story with my wifes family in their village in Loei regarding the land title to some of their land. The 30 rai of land was my wifes grandmother who passed away with no will. The land was orderly split up among the 12 kids, to include my wifes mother, at 2 1/2 rai for each. They have now sold it between themselves in the family and one aunt owns 15 rai, one aunt owns her original 2 1/2 rai and an uncle owns 12 1/2 rai. Now they all want to sell the 30 rai to me and the wife. The land has been in the family for about 50 years but a Sor Por Kor land title was issued to the grandmother before she died about 10 years ago, and the title is still in the dead grandmothers name. Sor Por Kor land can't be sold but can be passed down in the family which would include my wife. They claim they are going to get all the 12 original kids together and get the paperwork correct up to date but with only one hitch, one of the aunts lives in Japan and can't come to Thailand. I told them to call me when they get it resolved and we might talk then. I'm sure rural Issan has many stories like this concerning the land and who actually owns it and most of it is Sor Por Kor land and does not have a proper Chanote. As a Farang, I can only see my wife and I on the losing end of any future disputes considering the land ownership as they all see my wife as automatically rich since she is married to me.

Same kind of story here!Parents dead 15 years,60 rai in Buriram left w/o transfer and 8 siblings!Oldest daughter borrowed money against the land to buy inventory to start her Bangkok business.4 of the siblings stayed home to grow rice on the land and keep the proceeds!My wife was not one of them,a couple of years ago,the plan was that we should pay off the loan balance remaining of approx.400K so that the land could be transferred and then everyone would pay us back! :lol: :lol:

No thank you!I am not interested enough to find out what type of title it is! :lol:
