Spouse and Fiance(e) of an American Citizen

Spouse - If you are an American citizen you have two ways to bring your foreign spouse (husband or wife) to the United States to live. They are:

Immigrant visa for a Spouse of a U.S. Citizen (IR1 or CR1) - An immigrant Petition for Alien Relative, Form I-130 is required.
Nonimmigrant visa for spouse (K-3) - It is important to note that application for the nonimmigrant visa for spouse (K-3) who married a U.S. citizen must be filed and the visa must be issued in the country where the marriage took place. After the visa process has been completed, and the visa is issued, the spouse can travel to the United States to wait for the processing of the immigrant visa case.
Two petitions are required:
Petition for Alien Relative, Form 1-130; and
Petition for Alien Fianc้(e), Form I-129F
Fianc้(e) - If you are an American citizen, you may bring your fianc้(e) to the United States to marry and live here.

Nonimmigrant visa for fianc้(e) (K-1) - To travel to the United States for marriage. An
I-129F fianc้(e) petition is required.

Immigrant Visa for a Spouse (IR1 or CR1)
Nonimmigrant Visa for a Spouse (K-3)
Nonimmigrant Visa for a Fiance(e) (K-1)

I got married in Thailand in 2002 and took my wife to the US in 2003 on a CR1 Immigrant Visa. It was relatively easy and took about 6 weeks to get all the documents together and get the visa.

There is a US Immigration office near the embassy and I had to start there although I no longer remember why.

If you're interested in that process, I'd be happy to share what I remember over a beer or a meal. I still have some of the documents we needed.

She had her green card and SSAN within 2 weeks of arriving in the US.

I don't think there is such a thing as registering your marriage with the US Embassy, although it is necessary to register it with the Thai government to complete the visa process.

I see no advantage to the K3 over the CR1 unless you can not meet the financial test for the CR1, and need to return to the US and get a job before being able to meet the test.

udon expat thank you for the info and I also want to thank all the other who posted info
Now I would like to ask you about the CR1
I have not seen that any were or heard of it until you posted it
I am very curouis about that one
I also heard you need to have 27000 usd a year income to bring in your wife
correct me if that information is incorrect

The CR1 is an immigrant visa, the K3 is a non-immigrant visa for the spouse of a US citizen. Both processes begin with filing the I-130 with USCIS (the former INS). In many ways, it is a distinction without a difference, though some people have experienced a shorter wait time with the K3. With the K3 visa, you are simply applying for a CR1 and then submitting the fiance visa application material. You should only pursue a CR1 or K3 if your marriage is a legal marriage (as opposed to a ceremonial marriage.)

If you are not yet legally married and wanted to get married in the US, you should file the I-129F which begins the process for the K1 (fiance) visa.

If you and your wife are simply planning to visit the US as tourists from time to time (as opposed to moving there permenantly), applying for a B1/B2 (Tourist/Business) visa is also a possibility. They usually give aliens a 10 year B1/B2 so it is also a good alternative as you can usually get one within a month or two (depending on the wait time at the embassy.)

Agreed, the CR1 is an immigrant visa used if you're intending to reside in the US.

When I first returned with my wife I didn't know how long we would stay, so opted for the most permanent visa that required little followup after it was issued. Because we had been married less than 2 years we had to reaffirm that our marriage was still real after 2 years. Until then my wife had a 2 year provisional green card. After we jumped through that hoop she had a 10 year green card.

Near the end of 3 years in the US she applied for naturalization and became a US citizen after 3years 2.5 months in the US.

Shortly thereafter we decided to return to Thailand. Now we don't have to be concerned about visas for US visits as she's a citizen. Unfortunately, I'm still stuck dealing with Thai immigration. Don't expect that will go away.
