My friend needs advise about visa

PostAuthor: efxg57 » March 10, 2008, 5:02 pm

Okay, all you guys with so much knowledge about Thailand, my friend Martin needs some advise. he is currently back in the UK and will be return very soon. His question to me ( he is not a forum member) is if he divorces his Thai wife, what happens to his current Married "O" Visa? I told him I have no idea but will post it on Udonmap for help.
Thanks !!!!!!

Eddie,

I don't have a solid answer, but I think it's common sense that if the marriage is terminated then technically so would the extension based on marriage. But how would Immigration know unless the soon to be ex is vindictive and drops a dime.

There was a related topic on Thaivisa and the consensus was that immigration would unlikely find out.

However, I believe that Bob's earlier reply would be the best advise:

BobHelm wrote:
I have no personal knowledge of the marriage visa but have heard rumours that, once you are divorced & the authorities find out about it then the visa will be cancelled & you will only be given a 7 day visa & must then leave Thailand.
My advice would be that, as he is in the UK anyway, he invests 100 pounds in a non imm O multiple entry visa - reason for entry 'to visit family & friends'.
That way, once he is divorced there is no married person visa to cancel.
I do not think it would be sensible to come back on the marriage visa unless his only purpose was to get divorced & then return to UK.

Thanks Rito, read both replies, yours makes more sense, how would immigration find out unless his wife "drops a dime". I don't think Thailands computer system is that accurate, but who knows. BobHelm's statement made sense also. I'll pass it along to him

Thanks

if he is in doubt and he wants to return to Thailand, maybe better to be on the safe side and just apply for a tourist visa, no sweaty palms or brows when queing at immigation.

I think if he stays in the UK until the baht hits 70 to the GBP,he might not be back for some considerable time....maybe even years !! :( :(
But for the visa question....its quite possible that the Thais wouldnt find out about the divorce but if they did,and say your son stayed for 6 months on an ineligile visa,he would be hit by a very hefty fine.I think even if he pleaded ignorance to the law it wouldnt matter to the Thais.
Best to do as Bob says,as he's in the UK invest 100 quid on a multi entry non immigrant O visa and he can stay for up to 15 months here without any bother.

hxjohn well I am glad you are not the chairman of the board because I think otherwise
Thailand can not afford to go that strong it would wreck there export business
as your last statement said you never know wel I will bet it will never go to 28
it may go to 30 which I hope not but like you said you never know

Back on topic...

I definitely agree that your friend should obtain a non-imm 'O' whilst in UK... Hull is one of the easiest places to get this, and as his marriage visa will certainly be voided following divorce, it's cheap peace of mind at 100 sov's.

Eddie, your friend's best bet is to get his arse signed up in this forum and follow the advice of the UK bunch. The Hull consulate seems like the answer.

Wish we had one like it in the states. Closest, I reckon, is the Houston consulate although I favor the Thai Embassy in Washington, DC. Stay away from the Miami consulate, a lawyer's office, unless you like wallowing in bullsh!t.
