"O" visa based on marriage and first 90 day "

PostAuthor: 38nholding » August 21, 2008, 2:08 pm

Ok so we apply for the o visa based on marriage . trip to bkk blah blah blah. The application is then "under consideration" . Meantime i rush off to canada for triple bypass. On my return wife and I go to Nong kai to check on status of O visa.I thought something might be amiss, but wasn't sure.
Nope everything a go,bam wham stamp , my first O visa in twenty years visiting Thailand.Out of there with a smile ,check back in 90 days yippie right. Go back on monday and they look ,look again and say ,you have no visa because you went to canada"yeah but","you gave me,but but ".
Must go to Loas start again.
Border 8a.m and you guessed it ,because my visa was null and void since I came back from canada and got my I year visa ,I was overstay 60 days and the nice gentleman said " twenty thousand overstay, pay inside"
The nice folks at Nong kai gave me their number and said if we have a problem, to call. Wife figured time to call,"sorry ,cannot do anything ,have to pay"So about this time I am thinking I want to click my heels and be somewhere else. Gotta be a dream.Doesn't look like Kansas Toto? So I wander up to the atm and withdraw twenty thousand bhat to give to the nice folks at the border,go inside the office ,and for a joke I say "have one year visa ,why have to pay" grasping at straws at this point.
He says "you must go back to Nong kai and apply for exit visa" mmm shift in thinking. "oh I dont care if i lose my one year visa". Ok he says ,"go". Well ya dont have to tap me between the horns twice ,I start hoofing it .
well without hanging myself lets just say i dodged a bullet and the lesson is,even if your visa is under consideration in Bkk and have not gotten the results back you must apply for an exit visa on an O visa that you dont know if you are going to get.p.s 4 bdr house for sale I've had it.

38nholding, where you waiting for the approval when you went to Canada. If, then you should have gotten a "re-entry stamp" or did they say something different?

yes was waiting for approval. But thought because it was still under consideration did not matter. As well had they pointed it out to me when I went up there three months ago that my visa was invalid I would have corrected the problem then. But because they gave it to me wham ,stamp, and the nice little reminder that if i left thailand without exit visa blah blah blah .A complete oversight on there part

I'm just curious about one point. Did you have a stamp that gave you permission to stay in the kingdom? If so, then technically you did not overstay.

In any case, congratulations on dodging that bullet. If that had happened to me, I would sure feel sore about it.

After a few years, you will get used to this sort of thing. Hang in there. It does get easier.

38nholding, I just re-read your post and the situation.....my apologies.....I see they actually stamped your passport with an extension on the Non Immigration "O" visa for another year, and that is after you returned from Canada.

For those who are reading this, even if your extension is under consideration, get a re-entry stamp or you will have to start over.

What it seems to is that immigration saw their mistake and was trying to correct it at your expense. They weren't suppose to have given you the extension since you didn't have a re-entry visa. Even while your extension is under consideration, you need that re-entry visa.
