Texas practices capital punishment, do the US forumites believe this case will go all the way to the death penalty if they're found guilty of murder? I ask because the US has murder judged in varying degrees so how would this be assessed? Just looking for opinions, readers.

Probably not. First of all , the prosecuting District Attorney has to decide to ask for the death penalty and they won't do that unless they have a very strong case. Bad marks on the reputation if they lose, especially if near election time. Much easier to convict if on a lesser charge like manslaughter. Then it's up to the judge and jury to impose punishment if convicted. Just from reading the article presented here, a good defense attorney could make the case for a "crime of passion", temporary insanity or the like. Plus he would undoubtedly argue that the crime was provoked. There' probably a lot more to this than the article implies. But it's really up to the two entities I cited earlier, the DA and the jury. Just my opinion, I am not a lawyer but I do watch CSI and "Law and Order". :lol:
