Recording Assets before Marriage

PostAuthor: Naam Jai » December 20, 2007, 5:24 am

Has anyone recorded their assets either in Thailand or their home country prior to marriage, through a solicitor, to protect them in the case of a divorce?

Where a couple marry in the UK assets obtained prior to marriage are supposed to be excluded from any future divorce settlement.

I realise that if a child is born to that marriage then support for that child is claimed.

This seems particularly important in Thailand where one party may bring far more finance to the marriage.

I realise that if property is purchased jointly or the spouses land is involved and a house is built then that is deemed as part of the marriage assets.

Clearly if assets are not transferred to Thailand, it would be difficult for anyone in Thailand to sequestrate them? #-o

Yes and no. There has been a couple of cases taken all the way to the European Court, where the ex-wife (non-EU person) managed to successfully sue her ex-husband for a portion of his estate. Now, that's highly unlikely in the case of Thai females. I just don't think they would handle the entire procedure and they are too stingy to pay for this (given the distance, it would be expensive and lengthy). On the other hand, their greed is sometimes mindblowing, so one never knows. The best way to go about it is IMHO never to let her know about any assets that can be hidden from her (I treat my GOV the same way as if it were my wife and thanks God for Swiss banks!), have her sign prenap agreement and never ever take her to your farangland (don't even think about her getting some legal status in your country - unless you want to take her there). Whatever you bring with you to Thailand, kiss it goodbye!!!
